Adjudication Application 0241-2024 Respondent's submissions:
As the applicant I am allowed to see and comment on the respondents submissions. I have the right of reply.
First up there were 12 submissions, 8 for and 4 against. One of the negative submissions was compiled by a solicitor representing the body corporate and commissioned by the body corporate committee. The other 11 were from lot owners. A past chairperson penned an objection and two new owners, one less than 3 months, also objected.
The 8 submissions in favour are from, for the most part, long term owners who have a lot of experience dealing with this and past committees. You rarely get a chance, as a lot owner, to let the authorities in far off Brisbane know what is goin on here on the ground in Port Douglas. They didn't hold back. My reply is due on 22 July 2024 to BCCM after which the adjudication will proceed.
Swimming Pool Gates
We have 7 pool gates in stage 1 and they get a lot of use. Over the past 2 years I have found some of them not closing properly 10 times. Today we had an early morning visit from Work Place Health and Safety who inspected them for the second time in 2 weeks and he found nothing wrong with them.
There are 2 issues here. One is the gate must be able to close from any open position. The second issue is we, owners, residents and the caretaker's are responsible for the safety of the pool not the inspector.
Here is the problem. After a cold night there are 2 gates that can be left a whisker open but as the day warms up the gates lock perfectly. As a result of the visit I think awarness has been heightened.
