Transcript from the Webinar in response to a question about a BC committee not putting into effect the lawful decisions of the Body Corporate:

[00:38:45] - Nikki Jovicic (Lookupstrata Team)
The committee disagreed with two resolutions passed at the 2023 AGM and refused to implement them. Instead, they tried to overturn them at the 2024 AGM, but both motions were defeated. More than four months have passed since the 2004 AGM, and the resolutions have still not been implemented, what options are available to enforce compliance?

[00:39:07] - Chris Irons (Strata Solve)
I'll have a go. It's perfectly fine to disagree with the outcome. That happens. That's fine. But that's democracy as well. You've got to suck it up, frankly. It is perfectly acceptable for attempts to be made to rescind a decision because that's essentially what we're talking about here. But at the end of the day, if that attempt to rescind fails, which is what I think has occurred here based upon the question, then the committee is obliged under legislation to execute the decision. That's that, frankly. If the committee does not execute the decision, there needs to be a dispute resolution process initiated for it.

Chris Irons is a previous Commissioner of Body Corporate and Community Management (BCCM).

So you can see where we are at and I have taken the advice of Chris Irons and submitted an Application for Conciliation to BCCM.
