Conciliation Session 0140 - 2025 postponed:

One of our members applied for and paid for a Conciliation Session with the Office of the Commissioner for Body Corporate and Community Management (BCCM).
The application was accepted, allocated a file number and asigned to a Conciliator from the Department of Justice.
The applicant is myself and the respondent is the Body Corporate for Reef Terraces CTS 888*. It is usual that if the respondent is a body corporate (BC) it is represented by 2 voting committee members at the conciliation session.
Allowing plenty of time to prepare for the session it was scheduled for Friday 21 March 2025.
It is now postponed until Thursday 3 April 2025.
A conciliator is like a mediator which I think in our case will help to find a result to the dispute we are having.

*Conciliation between a lot owner and a BC committee does not fall under the juridiction of the BCCM Commissioner and so the respondent is the BC.

By-laws

The By-laws for Stage 1 are seriously out of date. Stage 2 were updated on 17 March 2023.
By-laws are essential for the smooth running of bodies corporate. They are decided by lot owners, checked for legalities by a solicitor and approved by lot owners at a general meeting. The solicitor then submits them to the Titles Office as the major part of a new Community Management Statement (CMS).
By-laws are not made by the BC committee they are made by lot owners.
