Body Corporate for Reef Terraces CTS 888 2022 Annual General Meeting (AGM)
Last year's AGM was remarkable. Directly after the AGM saw a 4 term committee member resign, the lodging of a Concilliation Application, an Adjudication Application to have the AGM declared void, five owners selling up, 22 owners demanding the replacement of the body corprate manager via a solicter's letter and the formation of the Reef Resort Owners Association Incorporated.
Adjudication Application 1286 - 2022
Under the BCCM Act an owner can enter into a dispute, not with the committee or manager only with the Body Corporate or another owner.
Chris Dahlberg submitted an Adjudication Application on 14 December 2022 which was finalised on 17 November 2023.
Although the application was dismissed Senior Adjudicator I Rosemann included 9 pages detailing her concerns, hopes, thoughts, investigations, submissions and conclusion. I have paraphrased some of them here:
Paragraphs [34] , [37] & [68] deal with the invalidity of the Committee election and the tardiness of committee in paragraph [40] in saying, in April, they will hold an EGM, but waiting until October to do so. The chair does not escape either by inappropriately ruling motions out of order, paragraph [68].
Need for an Administrator?
Paragraphs [39] & [41] deal with an Administator not being sought and in particular in [41] an Administrator would have been appointed if an application was made.

I agree with the Adjudicator on all points. The committee was discredited and that is probably enough on that subject. The body corporate now holds its future in its own hands with the 11 December 2023 Extraordinary General Meeting.
The Adjudicator concludes with; "Hopefully the committee election process at Reef Terraces will be resolved soon."
