If things go according to plan stage 1 lot owners will receive an invitation to make a submission about a new Adjudication Application 0241 - 2024.
This application deals with three things. Firstly a motion that passed at the AGM concerning the term of a new contract with a management firm. The application is not public yet so I have not put in the details.
The other parts of the application concerns the appointment of an Administrator and any other order the Adjudicator deems necessary.
Adjudication Applications become public after Final Order/s are made. For instance, our last Adjudication Application 1286 - 2022 became public on 17 November 2023 where it was made abundantly clear at paragraph [41] an Administrator would have been appointed had one been asked for concerning Committee elections:
"[41]............The only alternative to the purported committee to call an EGM would be to wait for an adjudicator's order (which could only be made in response to a specific application seeking such an order) to authorise the purported committee or an administrator to call the meetings. No one has sought any such orders. Given the likelihood that any such orders would be made if sought, little would be achieved by delaying the matter."
I think what is needed is a fair Committee election and appointing an Administrator seems the fairest way of doing it.
